The system of state control over the operational-search activity in Ukraine

ABSTRACT. The article contains the results of the analysis of problematic issues of state control over the conduct of operational-search activity (OSA) in Ukraine. The authors state that the current Law of Ukraine «On Operative-Search Activity» has formed a clear system of control over operational-search activity, and this system has been functioning to this day. It describes which state bodies and their subdivisions are authorized to exercise control over operational-search activity.

The authors draw the reader’s attention to the fact that the issues of this control have been updated in the draft Laws of Ukraine. These are three projects from 2016, 2017 and 2019. These projects provided for the following types of control over OSA: state control; non-departmental control; departmental control; parliamentary control; court control; public control. Subjects of all types of control are designated.

In addition, the article briefly discusses all types of control over OSA, which are reflected in the draft Laws of Ukraine. The authors draw attention to the fact that the allocation of a separate article of the law of state control as a specific concept in comparison with the generic concepts of departmental and non-departmental control is a dubious decision in the light of legal technique.

In addition, the authors are critical of the described procedure for parliamentary control. So, for example, the right of the authorized Committee of the Verkhovna Rada of Ukraine to hear explanations about the results of the implementation of the Law of Ukraine «On OSA» and on the observance of the rule of law, looks doubtful. This is because the procedure for such an oral hearing will not provide an opportunity to establish and double-check the truth. In this form, this procedure is more like informing about statistical information, and not like control by the parliament.

Court control over OSA is described in most detail. The authors of the article support this approach of the legislature.
