ABSTRACT. Realities require an immediate response and the presence of legal regulation of both material and procedural norms for relevant challenges. Taking into account the martial law introduced in Ukraine, the legal aspects of the changes that have taken place in the criminal procedural code of Ukraine since the beginning of the full
scale invasion of the Russian Federation on the territory of our state are considered. Due to the current Law of Ukraine “On the Legal Regime of Martial Law” the inadmissibility of termination of the powers of state authorities and other state bodies in conditions of martial law is determined. This provision of the Law clearly highlights the fact that during the period of martial law, the powers of courts, prosecutor’s offices of Ukraine, bodies carrying out investigative activities and pre-trial investigations cannot be suspended.

The changes in the criminal procedural code of Ukraine during the martial law analyzed by the author indicate a response to real challenges, the appropriateness of which can be determined in practice. In particular, changes were made to the provisions of the Criminal Procedure Code of Ukraine, which regulate the following issues: entering data into the EDPR in the absence of access to it; procedure for carrying out certain investigative (search) actions, as well as requirements for their conduct; use of testimony in court as evidence; suspension of pre-trial investigation periods; restoration of lost materials of criminal proceedings under martial law; cooperation with the International Criminal Court, etc.
