ABSTRACT. The article examines the criminal procedural regulation of cases of closure of criminal proceedings at the pre-trial investigation stage. The cases of criminal proceedings closure are classified into groups: 1) grounds for closure of criminal proceedings by the investigator and the inquiring officer; 2) grounds for closing criminal proceedings by a prosecutor, including closure of criminal proceedings against a legal entity; 3) cases where a prosecutor is authorised to apply to the court with a motion to close criminal proceedings.

It is proposed: 1) to introduce in Article 284 of the Criminal Procedure Code of Ukraine «Closure of Criminal Proceedings and Proceedings in respect of a Legal Entity» a through numbering of the grounds for closing criminal proceedings, eliminating the current cases of duplication in the numbering of individual paragraphs; 2) to use the reference method to establish links between legal provisions. The analysed powers of the subjects to close criminal proceedings should be additionally regulated in the articles of the Criminal Procedure Code of Ukraine devoted to the special criminal procedural status of these subjects in the list of their respective powers, namely, in Article 40 «Investigator of the pre-trial investigation agency», Article 40-1 «Inquiring officer», Article 36 «Public prosecutor» of the Criminal procedure code of Ukraine; 3) to amend the current Order of the Ministry of Internal Affairs of Ukraine «On the Organisation of the Activities of Investigative Units of the National Police of Ukraine» in order to supplement the Regulation on Investigative Units of the National Police of Ukraine with paragraph 4-1 of part 1 of Article 284 of the Criminal Procedure Code of Ukraine «the law establishing the criminal unlawfulness of the act has ceased to be in force» in order to properly analyse the validity of such decisions by investigators-methodologists when providing practical and methodological assistance in organising the work of investigative units.
