ABSTRACT. The article deals with peculiarities of the implementation of operative and search activity in the conditions of the state of war. The given characteristic is the concept of security. An analysis of the current state of security in Ukraine was carried out based on international ratings. The dependence between the level of security and the effectiveness of operative and search activity in the conditions of state of war has been established.

A detailed analysis of the legislation made it possible to come to the conclusion that the modern regulation of operative and search activity needs to be improved and brought into line with today’s needs. It is necessary to adapt the legislation, which regulates operative and search activity, to the conditions of the state of war and the post-war period, taking into account external and internal threats to the national security of Ukraine. It was established that there are significant legal and organizational miscalculations in operative and search activity, which does not allow using the entire complex of means and measures to ensure the effective operation of the forces of the security and defense sector of Ukraine in the conditions of the state of war.

It is noted that there is an urgent need to revise the existing approach to the implementation of investigative activities in terms of the legal argumentation of the need to conduct operative and search activity in the direction of reducing bureaucratic influence to ensure the efficiency and effectiveness of operative and search activity, which in the conditions of the state of war is of crucial importance both for protection of the rights and freedoms of the citizens of Ukraine, as well as for the defense capability of the country in general.

It is noted that the state of ensuring the rights and freedoms of citizens, as well as the forms of their limitation in operative and search activity at the legislative level, do not correspond to the real operative investigative situation and conditions of the state of war.
