ABSTRACT. The article deals with a problem of great importance for modern jurisprudence – the stability of legal conditions and guarantees of institutional protection of subjective civil rights as key legal opportunities of a person in the conditions of a market economy and civil society. Systemically related to the category of such protection is the issue of continuity of institutional protection of civil rights (continuity), which reflects legal ideas about the established, stable, continuous activity of the relevant institutions.

Such continuity corresponds to the principles of the rule of law, which is recognized and operates in Ukraine in accordance with the first part of Article 8 of the Constitution of Ukraine, and also characterizes the peculiarities of the internal organization of those bodies that embody the specified protection in their activities, exercising the appropriate powers granted to them by law on behalf of society. Among other forms of protection of civil rights, the judicial form of their protection is considered a priority, which determines the need to study this problem in the institutional aspect. According to modern scientific concepts, the continuity of the functioning of the judicial power corresponds to the judicial protection of civil rights, which carries out activities to resolve conflicts, protect the rights, freedoms and interests of individuals, ensures the continuity of the judicial review of the relevant category of cases and the judicial protection of civil rights.

Maintaining the regime of continuous functioning of the judicial power under modern conditions is of considerable public interest and has a significant political and legal significance in the conditions of martial law introduced in Ukraine from 24.02.2022 by Decree of the President of Ukraine dated 24.02.2022 No. 64/2022 “On the introduction of martial law in Ukraine” After all, even in these legal conditions, the judiciary must demonstrate the continuity of protection of human rights, including civil rights, which is confirmed both at the doctrinal and normative legal levels.
